Abstract :

Custody of children of foreign ordinary residents who are ought to India has raised innumerable complex problems. The need to deal with such issues judiciously has been stressed in the future interests of such children. A study is undertaken in the light of series of decisions. The welfare of minor children must be the most important consideration, in the applicability of comity of courts. Legal issues relating to the custody of children has been studied. Several suggestions have been made.
